Terms of Service

These Terms of Service (“Terms”) govern your use of the Avyndo website (avyndo.com) and the Avyndo products and services, including Avyndo OS, Avyndo MDM, and Avyndo Commerce (together, the “Services”). The Services are operated by Avyndo, part of Fastlane Grupp OÜ, registered in Estonia(“Avyndo”, “we”, “us”). By using the Services you agree to these Terms.

1. The Services

Avyndo provides platform software: device management (Avyndo MDM), commerce and point-of-transaction software (Avyndo Commerce), and an operating system platform in development (Avyndo OS). Specific features, service levels, and pricing are agreed in an order form or subscription agreement where applicable; those agreements take precedence over these Terms if they conflict.

2. Accounts

• You must provide accurate information when creating an account and keep credentials confidential.
• You are responsible for activity under your account. Notify us immediately of any unauthorized use.
• Business accounts: the organization that creates a workspace is responsible for its administrators and end users.

3. Acceptable use

You agree not to:

• use the Services to violate any law or the rights of others;
• enroll or manage devices you do not own or lack authority to manage;
• probe, disrupt, or circumvent security or usage limits of the Services;
• resell or provide the Services to third parties except as expressly agreed.

4. Open source

Avyndo OS and certain components are released under open-source licenses. Those licenses govern your use of the corresponding source code and binaries; nothing in these Terms restricts rights granted by an applicable open-source license.

5. Data protection

Our processing of personal data is described in the Privacy Policy. Where Avyndo processes personal data on behalf of a business customer (for example device data in Avyndo MDM or transaction data in Avyndo Commerce), a data processing agreement applies.

6. Intellectual property

The Services, the Avyndo name, logo, and design system are the property of Avyndo or its licensors. Except for rights granted by an open-source license or expressly in writing, no rights are transferred to you.

7. Availability and changes

We work to keep the Services available and secure, but they are provided “as is” and “as available”. We may modify or discontinue features with reasonable notice where practicable. Pre-release software (including Avyndo OS while in development) is provided without any availability commitment.

8. Liability

To the maximum extent permitted by law, Avyndo is not liable for indirect, incidental, or consequential damages, loss of profits, or loss of data. Our aggregate liability for claims arising out of the Services is limited to the amounts you paid for the Services in the twelve months preceding the claim. Nothing in these Terms limits liability that cannot be limited by law.

9. Termination

You may stop using the Services at any time. We may suspend or terminate access for material breach of these Terms. Upon termination, provisions that by their nature survive (including intellectual property, liability, and governing law) remain in effect.

10. Governing law

These Terms are governed by the laws of Estonia. Disputes are subject to the exclusive jurisdiction of the courts of Estonia, without prejudice to mandatory consumer protections in your country of residence.
